Terms of Service

These Terms of Service govern your access to and use of FluxArt, including our website, AI creative tools, account features, billing features, generation history, uploads, downloads, and related services.

By accessing FluxArt, creating an account, submitting a generation request, uploading content, purchasing credits, or subscribing to a plan, you agree to these Terms. If you do not agree, do not use FluxArt.

FluxArt is an AI creative workspace for generating and managing images, videos, audio-related assets, and related media from prompts, uploaded assets, reference materials, source tasks, and generation settings.

AI generation is probabilistic. Outputs may vary, fail, contain artifacts, resemble other outputs, include unexpected or offensive elements, or not match your expectations. FluxArt does not guarantee that any output will be accurate, unique, available, non-infringing, suitable for commercial use, or fit for a particular purpose.

We may update, replace, limit, suspend, or discontinue models, workflows, settings, credit rules, prices, features, or availability at any time.

You may need an account to use certain features. You agree to provide accurate information, keep your login credentials secure, and notify us if you suspect unauthorized access.

You are responsible for all activity under your account. FluxArt is not responsible for losses caused by your failure to secure your account.

FluxArt is not intended for children under 13, or a higher age where required by local law. Users under 18 may use FluxArt only with involvement and consent from a parent or legal guardian. If you use FluxArt on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Inputs include prompts, uploaded images, uploaded videos, uploaded audio, reference assets, source task identifiers, metadata, likenesses, voices, and generation settings that you submit to FluxArt.

You represent that you have all rights, permissions, licenses, releases, and consents needed to submit your inputs and to allow FluxArt and service providers to store, transmit, process, transform, and display them for the purpose of providing the service.

Do not upload private, confidential, sensitive, regulated, third-party, biometric, or personal content unless you have the right to do so and accept the risks associated with processing that content through an online AI service and third-party AI model/API providers.

Subject to your compliance with these Terms, FluxArt does not claim ownership of the creative inputs you submit. Rights in generated outputs may depend on your inputs, selected model, plan, applicable law, third-party rights, and the terms of any AI model/API or infrastructure providers involved in the generation.

Paid plan features that reference commercial use are permission to use FluxArt under that plan. They are not a guarantee that an output is legally cleared for every commercial, advertising, client, marketplace, or public-media use.

You are responsible for reviewing generated content before publishing, selling, distributing, or using it in advertising, client work, public media, products, or commercial projects. You are responsible for copyright, trademark, publicity, privacy, likeness, voice, music, performer, location, and other rights clearances.

You must not represent AI-generated content as human-created when that would be deceptive, unlawful, or likely to mislead others. You are responsible for any required AI, synthetic media, advertising, or sponsored-content disclosures.

You may not use FluxArt to impersonate a real person without permission, create misleading synthetic media, falsely suggest endorsement, manipulate public-interest media in a deceptive way, or generate content that could reasonably mislead people about a person's identity, speech, actions, consent, or beliefs.

You may not upload or generate another person's face, body, voice, performance, or private likeness unless you have the rights and consents needed for your intended use.

You are responsible for complying with laws and platform rules that require labeling, disclosure, consent, or provenance information for AI-generated or manipulated content, including deepfake or realistic synthetic media obligations where applicable.

You agree not to use FluxArt to create, upload, request, distribute, or promote content that is illegal, harmful, abusive, defamatory, harassing, hateful, sexually exploitative, violent, fraudulent, infringing, privacy-invasive, or otherwise unsafe.

FluxArt strictly prohibits NSFW content, pornography, explicit sexual content, sexual nudity, adult content, fetish or sexual-service content, non-consensual intimate imagery, and any sexual or exploitative content involving minors.

You may not use FluxArt to exploit minors, create sexual content involving minors, create non-consensual intimate imagery, commit fraud, spread malware, harass people, evade safety controls, scrape or reverse engineer the service, overload our systems, resell unauthorized access, or use outputs to train a competing service where prohibited.

We may automatically or manually review prompts, uploads, generated outputs, account activity, and payment activity to enforce these Terms, prevent abuse, investigate violations, and protect FluxArt. We may refuse, block, remove, restrict, or disable generation requests, content, features, credits, or accounts when we believe there is a violation or risk.

Some FluxArt features require credits. The credit cost may vary by model, workflow, duration, resolution, output count, audio setting, input type, provider cost, plan, discount, and other generation settings. FluxArt may show an estimated cost before generation.

When you start a generation task, credits may be frozen. If the task succeeds, the frozen credits are consumed. If the task fails before completion because of a FluxArt system error or service-provider error, the frozen credits are released back to your account. Credits are not returned for successful generations, user error, unsatisfactory creative results, policy violations, abuse, or misuse, except where required by law.

Current credit validity rules are: new-user welcome credits are valid for 30 days after issue; monthly subscription credits are valid for 30 days after issue; yearly subscription credits are valid for 365 days after issue; and one-time purchased credit packages are valid for 365 days after purchase. Manually adjusted, promotional, or support-issued credits may follow the validity period shown when they are issued.

If the pricing page, checkout page, credits page, or account page shows a different credit validity period because of a product update, promotion, account-specific offer, or legally required change, the displayed period controls. Expired credits are not refundable, extendable, transferable, or redeemable for cash except where required by law or expressly stated by FluxArt.

Credits have no cash value, are not legal tender, are not transferable, and may not be redeemed for money except where required by law.

FluxArt uses Creem for checkout, subscriptions, invoices, payment status, and related billing events. Subscriptions may renew automatically unless canceled before the renewal date. You may use the Manage Subscription entry on FluxArt to open the Creem customer portal and manage or cancel a subscription. Cancellation stops future renewals but does not automatically refund the current billing period. Refunds are handled according to our Refund Policy and applicable law.

Refund eligibility, failed-generation credit releases, subscription cancellations, and credit-package rules are described in the FluxArt Refund Policy. If there is a conflict between a pricing page and the Refund Policy, the Refund Policy controls for refund handling unless applicable law requires otherwise.

If you believe a charge or credit transaction is incorrect, contact us promptly at support@fluxart.org. Support requests are typically answered within 24 hours. Filing abusive chargebacks, using multiple accounts to exploit credits, or attempting to obtain services without payment may result in account restrictions and loss of credits.

FluxArt may rely on Creem, authentication providers, Brevo, S3-compatible storage providers, cloud hosting, analytics and performance tools, email services, and third-party AI model/API providers to operate the service.

Third-party services may have their own terms, policies, limits, safety systems, processing times, availability, output restrictions, and data handling practices. FluxArt is not responsible for third-party service failures, policy changes, outages, blocked requests, or restrictions outside our control.

Different AI models may support different inputs, durations, resolutions, audio settings, safety checks, output formats, and usage rights. FluxArt may change model availability or route generation requests through different providers without guaranteeing equivalent output.

FluxArt and its licensors retain all rights in the FluxArt website, product design, software, code, workflows, documentation, trademarks, logos, pricing systems, and platform infrastructure.

These Terms do not grant you any right to copy, modify, reverse engineer, resell, sublicense, or create derivative services from FluxArt except as expressly allowed by us in writing.

If you believe content on FluxArt infringes your rights, contact us at support@fluxart.org with enough information to identify the content, your rights, and how to reach you. We may remove or restrict content and may suspend repeat infringers or accounts that create legal or operational risk.

We may update, change, limit, suspend, or discontinue parts of FluxArt at any time, including models, workflows, features, prices, credit rules, plan benefits, storage limits, or availability.

We may suspend or terminate access if we believe you violated these Terms, created risk for FluxArt or others, used the service abusively, failed to pay, attempted payment fraud, violated provider rules, or acted in a way that may expose FluxArt to legal or operational harm.

If your account is suspended or terminated for violation, fraud, abuse, or safety risk, you may lose access to credits, generated content, and account history to the maximum extent permitted by law.

FluxArt is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, and uninterrupted operation.

You acknowledge that AI systems may produce unexpected, inaccurate, offensive, biased, infringing, unsafe, or unusable results. You use FluxArt and generated outputs at your own risk.

To the maximum extent permitted by law, FluxArt will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunities, content, credits, or generated outputs.

To the maximum extent permitted by law, our total liability for any claim related to FluxArt will not exceed the amount you paid to FluxArt for the service giving rise to the claim during the three months before the event that caused the claim.

You agree to defend, indemnify, and hold FluxArt harmless from claims, damages, liabilities, losses, costs, and expenses arising from your inputs, generated content, use of FluxArt, violation of these Terms, violation of third-party rights, violation of applicable law, or misuse of AI-generated or manipulated media.

We may update these Terms from time to time. If we make material changes, we will update the date above and may provide additional notice through the service or by email when appropriate.

Your continued use of FluxArt after updated Terms take effect means you accept the updated Terms.
